[Photo: Standard Digital]The move by Raila Odinga-led Opposition to remove some IEBC officials from office is unconstitutional, Attorney General Githu Muigai has told a High Court in Nakuru.In his submissions in a case in which 12 Nakuru residents have sued NASA leaders, Muigai told the court to stop the opposition leaders from ejecting the officials terming their means illegal."The move is unconstitutional and contrary to the findings of the Supreme Court. The Court was categorical that it is the IEBC which is composed of commissioners that is mandated to conduct a fresh presidential election," he said in his submissions through State Counsel Jennifer Gitiri.The AG further noted that the actions of NASA are aimed at crippling the electoral commission from performing its job as provided for by the Constitution.The residents filed the case, through lawyer Kibe Mungai, seeking among other things, orders to restrain NASA leaders led by their presidential candidate Raila from interfering with the electoral agency as it prepares to conduct the fresh poll on October 26.The petitioners filed the case under the certificate of urgency, last week.On Monday, NASA supporters staged mass protests in various parts of the country demanding the resignation of the officials they accuse of bungling the August 8 election.The Opposition has maintained that no election will take place if the officials do not vacate office.
