The 15 year jail term handed to famous Kasarani-based popular cop, Titus Ngamau alias Katitu, is to be appealed according to his lawyer Cliff Ombeta.
Mr. Cliff Ombeta revealed on Friday that he has already filed a notice of appeal. According to the lawyer, the judgement was based on sentiments rather than merit.
"We have already put a notice for appeal and we believe that this case was actually not judged on its merit but we believe it was judged on sentiments," said Mr. Ombeta.
Speaking to KTN news on Friday by means of phone, Mr. Ombeta criticised the idea that the other three police officers who were on duty with Katitu on that particular day were not involved in the case.
"The guns that was used in this case has not been found. Secondly their were three police officers on duty on that day who all shot using their guns.Why were those officers not charged or called as witnesses?" asked Mr. Ombeta.
However, despite the move to appeal the judgement, the lawyer agreed that the sentencing was better off than hanging.
"The bullet that was found in the back of the skull was not from the gun that Katitu was using on that particular day. In any case, he has been found guilty and the court has decided. I tend to think that the 15 years that he has been given is good in comparison to hanging that would have been there," he added.
