The government will appeal the High Court ruling that declared self-proclaimed National Resistance Movement (NRM) leader Miguna Miguna’s deportation illegal, null and void.

According to the Interior Principal Secretary (PS), Karanja Kibicho, High Court Judge Luka Kimaru ruling that declared Miguna’s deportation illegal was not in the interest of the country.

“As we are told to respect court orders, the government still stands its ground that Miguna’s deportation was done procedurally and in accordance with the law,” Kibicho told reporters at Harambee House on Thursday.

The PS also said that Judge Kimaru’s ruling that Miguna be handed back his ‘illegally’ acquired passport was not in the interest of the country.

He said that government lawyers are reviewing the ruling before moving to the court of appeal later today.

On Thursday, Kimaru ruled that Miguna’s deportation to Canada was illegal, null and void.

Kimaru directed the Director of Immigration to surrender Miguna’s passport in court within the next seven days.

Miguna was arrested, detained and later deported after his role in Raila Odinga’s inauguration as the people’s president.

The self-proclaimed NRM leader deportation elicited sharp criticism with the opposition accusing the government of contravening the law.

Miguna had vowed to fight the deportation which he said violated his rights.
