A section of Machakos Members of the County Assembly have filed a notice for an impeachment motion against Governor Alfred Mutua just three weeks after the plan was hatched.
Ndalani MCA Stephen Muthuka filed the notice on Wednesday where he accused Mutua of breaching procurement laws, the Constitution and the County Government Act.
The impeachment papers allege that Mutua paid a fictitious Sh89 million recorded for de-silting the Maruba Dam as well as awarding a road building contract to a clearing and forwarding firm.
“The works are purported to have been done in January and February 2016 but, during the period in question, Machakos County was experiencing El-Nino rains and the desilting could not have been done,” says Mr Muthuka in the notice.
the MCA further alleges that the county government made the payment on a false certificate and that this was not backed by any actual activity on the ground.
Also included is the accusation saying Mutua irregularly presided over transfer of Sh161 million from the county government coffers to other personal account, as well as his use of county funds to popularise Maendeleo Chap Chap party.
“The governor and the county government has set and maintained an M-Pesa line and paybill number 656500 to which money was and continues to be paid," reads Muthuka's statement as recorded by the Nation.
"However, the same is not deposited into the county government accounts and is instead withdrawn and consumed at source, contrary to provisions of the County government Act."
Dr Mutua also allegedly mismanaged Sh600 million from the department of transport, roads and public works as well as irregularly purchasing vehicles at the county government.
“The governor and the county government procured 70 ambulances, amounting to Sh145 million, and 140 TIDA Saloon vehicles, amounting to Sh219 million, without following the Public Procurement and Disposal Act,” Mr Muthuka charges.
Already some a total of seven Machakos County officials are in court over the allegations even as County Assembly Speaker Bernard Mung’ata says Mutua has seven days to make a response to the allegations in the notice.
