Kisumu Governor Prof Anyang Nyong'o has sued the government over what he termed as 'unwarranted and discriminatory' withdrawal of his security personnel by the state.
Enjoined in the case is his Deputy Dr Ochieng' Owili whose security has also been allegedly withdrawn.
The matter before justice David Majanja of the Kisumu high court however failed to take off today as the office of the Attorney General requested for time to file a response.
"The AG has been compelled to file a response by tomorrow (Wednesday) morning where the matter will be revisited.
"Security is a constitutional entitlement to elected leaders in this country and to withdraw them without any reference to the affected is an illegality," Dr Owili told journalists outside the court.
The deputy governor noted that the continued affront to the law by the state will not cow them from recognising opposition leader Raila Odinga as the people's president.
The two are part of opposition leaders whose security personnel have reportedly been withdrawn for taking part in Odinga'a oath taking ceremony.
Other leaders whose bodyguards have been withdrawn include the NASA principals; Kalonzo Musyoka, Musalia Mudavadi and Moses Wetangula among others.
