The presiding judge, Thrispisa Cherere ordered that the petitioner’s security be reinstated immediately pending the hearing and determination of the case on the 28th February this year.

Justice Cherere further directed the two to file an application to be joined in a similar case filed by Homa Bay Town MP Opondo Kaluma in Nairobi, which is due on February 19.

According to the judge, it would be a waste time for two different courts to listen to a similar matter adding that joining the Nairobi case will also prevent any conflicting decisions which could embarrass the judiciary in the end.

“The applicants here have the liberty to apply to be enjoined in the judicial review petition number 44/2018,” Justice Cherere stated.

The two moved to court after the government withdrew security officers attached to them

In the case, Prof Nyong’o and Owili through their lawyer Ibrahim Stanley Ogejo argued that they were left vulnerable after their security was withdrawn.

The Inspector General Joseph Boinett, Interior Cabinet Secretary Fred Matiang'i and the Attorney General Githu Muigai were listed as respondents.
