Kilifi Governor Amason Kingi has accused Justice Weldon Korir of being biased in an election petition challenging his re-election in the August 8 general election. The county boss now wants the judge to recuse himself from the petition. Kingi argued that the judge is incapable of delivering a fair ruling.Through lawyers Ben Mosota and Aoko Otieno, the vocal governor said the actions of the judge clearly show that he cannot rule without fear or favour.The Governor’s request came after the judge issued two rulings in which he gave former Labour CS Kazungu Kambi a go-ahead to deposit the petition’s security without making a formal application.Justice Korir also dismissed another petition against Kingi, arguing it was filed out of time.The county boss accused the judge of favouring his opponent, arguing that the decision to allow Kambi to deposit security shows his lack of impartiality in the case."The judge predicted the two rulings to save the petition from being struck out as per law,” said Kingi, as quoted by The Star.The Governor now seeks to have the file transferred to Chief Justice David Maraga to appoint and gazette another judge for the petition.Kazungu, who garnered 44, 470 votes against Kingi’s 280,686, has also sued the Independent Electoral and Boundaries Commission (IEBC).
