Mombasa Governor Ali Hassan Joho and former Senator Hassan Omar are appearing at the Mombasa High court for a case challenging his (Joho) win in the August 8 general elections.
The two arrived in court by 10 am Tuesday, a month after Lady Justice Lydia Achonde declined to strike out the petition.
Joho had filed the application seeking the court to strike out the petition filed by Omar, a former Wiper Democratic Movement.
According to Joho who is also the ODM deputy party leader, his deputy Dr William Kingi was not enjoined in the petition, and so it lacked merit sinceJustice Achonde on October 24, said it was Joho who was elected during the election and so there was no need to enjoin deputy governor.
Omar who wants Joho's re-election nullified, has since said he would vie on a Jubilee party ticket if the court grants him his wish.
