In her ruling on Thursday, Lady Justice Lydia Achode dismissed Omar's petition saying that he had failed to prove to the court that the August 8, 2017 election that saw Joho reelected with a landslide was marred by irregularities.

To further compound the former Wiper Secretary General's agony, the Court ordered him to pay a fine of Kshs. 8 million as compensation to Joho and the electoral body, IEBC.

However, while speaking to the  Nation, the former Senator hinted that he would appeal the ruling even as he vowed to take disciplinary action against Justice Achode whom he had accused of being ' openly biased' against him.

"The ruling was predetermined. The judge conducted herself in an unprofessional manner, was deliberately undermining the case and refused to withdraw...we are not only going to appeal but seek disciplinary action against her," he said.

In the August 8 contest, Omar garnered 43,000 votes against Joho's 220,000.
