Two cases where the Nakuru County Government has been sued by the Commercial Estate Owners, hawkers and street vendors respectively will be heard together on June 16, 2015.
The business owners have accused the Govenor, Kinuthia Mbugua's Administration of infringing their rights by relocating the street vendors and hawkers along their building alleys.
Hawkers accused the County Government of forceful eviction from the Central Business District and relocating them along congested and poorly sanitized alleys where business is poor.
Judge Abigael Mshila told the court that the two petitions will be heard and canvassed together as they dwell and revolve around on the same issues.
She instructed all parties to file and serve each other relevant documents within 21 days when they will come for highlighting of the submissions.
Commercial business owners include; the Nakuru Cosmetics Centre, Farmers World Centre and the Eagle Palace Hotel.
In their separate petition, the business owners had also asked to be enjoined in the Hawkers and street vendor’s case in an application dated December 24, 2015.
They had made the request noting it would be erroneous for the petitioners not to include them in the case as the matter affects them as well.
The Business owners alleged they were included in a negotiation process with the hawkers in 2013 and been part of those affected, they submitted it would be rightful for them to be enjoined.
In January 2015, the Nakuru County embarked in forceful eviction of street vendors and hawkers from the Central Business District and settled them along the alleys of the commercial business owners.
Controversy has since brewed as both parties accuse the county government of conducting the resettlement improperly.
The Business commercial owners had also threatened to stop paying land rates if their freedom of rights continue been infringed on.
