The hearing of a petition against Kisii county governor James Ongwae will begin on October 5.
High Court judge Hellen Omondi ordered both parties to ensure their submissions are ready before the hearing starts.
This is after Wiper party candidate Lumumba Nyaberi who unsuccessfully vied for Kisii governor filed a petition to challenge the election of governor Ongwae of ODM.
Nyaberi claimed that the election process was marred by irregularities and the court should nullify his victory.
The petitioner said Ongwae used county staff as his chief agents during the August 8 general election.
Ongwae has also maintained that he was duly elected and won the race fairly.
