A high court in kisumu has altered the sentence of a woman convicted of manufacturing and parking alcoholic drinks in un-prescribed containers.

Zainab Barasa had been sentenced to a fine of Sh50,000 and a five-year jail term by principal magistrate R. Oanda in Ukwala.

She pleaded guilty to the charges and was fined of Sh50,000 or serve a five-year prison term in default. She appealed the sentence and relied on the written submission on which she beseeched the court to forgive her with a promise never to repeat the offence.

In her judgment, Justice Esther Maina said that the previous sentence was illegal given that it required the appellant to serve five years instead of three years in default of fine payment. 

"The appeal now succeeds to the extent that the sentence is altered to a fine of Sh50,000 in default and three years imprisonment," said Maina.

On may 20, 2014, Barasa was found with 200 litres of illicit brew (busaa) in un-prescribed container at Ligingo in Ugenya district, Siaya County.
