The judge ruled that the Political Parties Tribunal erred and acted against the law by barring Ms Kihika from Nakuru senatorial race because it had no jurisdiction to hear and determine the matter.
Ms Kihika, who is the Jubilee Party nominee, was stopped from running on grounds that she had not resigned as speaker prompting her to proceed to ask the High Court to nullify the ruling by the Political Parties Disputes Tribunal excluding her from running for the Senate seat.
The petition against Kihika was filed by Margaret Wanjiru Kiiru who is vying for the seat as an independent candidate.
