The High Court has dismissed an application for bail by all eight Cord and Jubilee lawmakers held over hate speech.
The leaders, who were arraigned in a magistrate's court on Tuesday over alleged hate speech, had moved to the Court seeking their release on bail.
Those in custody include: Machakos Senator Johnson Muthama Ferdinand Waititu (Kabete), MPs Junet Mohamed (Suna East), Timothy Bosire (Kitutu Masaba), Moses Kuria (Gatundu South) and Kimani Ngunjiri of Bahati.
Women representatives Florence Mutua (Busia) and Aisha Jumwa (Kilifi) are also in police custody over hate speech.
The leaders spent their second night at Pangani and Muthaiga police stations.
Justice Joseph Onguto said “he would explain on Thursday why he dismissed the application.”
In the bail application the lawmakers claimed that they had been held for several hours without food, water and access to medication.
They also said they had not been allowed to see their relatives or spouses.
They had sued the Inspector-General of police, the Director of Public Prosecutions and the Directorate of Criminal Investigations.
Also enjoined in the application was University of Nairobi students' union leader Babu Owino.
