The High Court has suspended Interior CS Fred Matiangi's declaration that Miguna is a prohibited immigrant.
High Court Judge Chacha Mwita issued conservatory orders revoking Miguna's deportation until his petition is heard and determined.
He ordered the government through the Ministry of Interior and specifically the immigration department to facilitate his re-entry using his Canadian passport.
Speaking shortly after the ruling, Miguna's lawyer James Orengo applauded the court for issuing the directive adding that the deportation of Miguna was unjust.
"What has happened to Miguna Miguna is despicable and the only solution for the court is to stand firm in defense of the constitution. So long as the Courts continue to protect and defend the Constitution, there is some space, for Kenyans who want to live in a free and democratic society.
"Whenever we are about to give up, the courts come up with these decisions which give us hope that the constitution of Kenya is alive," Orengo told the media.
