The high Court has squashed a  Sh1 million bond that was given to preacher Gilbert Deya.While pronouncing the ruling, Justice Luka Kimaru on Thursday said that Pastor Deya will remain in custody until his child theft case is heard and determined.Justice Kimaru overturned an earlier ruling by a lower court after senior assistant DPP Nicholas Mukutu appealed for Deya not to be released on bond citing the extend of past conduct.The controversial preacher was accused of running into exile and also forging Court orders to put off his prosecution."That the trial magistrate exercised his discretion illegally,  wrongly and improperly in granting bond and in issuing the orders to have Deya released," the prosecution argued.His lawyer Swaka, argued that Deya needed to get treatment outside prison remand but the judge directed that he can get medication at Kenyatta National Hospital on demand.The prosecution were also given 90 more days to complete investigations making a total of 210 days.Pastor Deya was expected to be released on January 17 2018 before the case took a new twist.
