[Photo| @NationBreaking]It is a sigh of relief for Vihiga Governor Wilbur Ottichilo after Kakamega High Court on Monday upheld his win in the August 8 General Election. Justice Ruth Sitati dismissed, with costs, a case challenging Ottichilo victory which was filed by a voter, Hamzah Musuri Kevogo. The petitioner had argued that the governor’s 82,220 votes were invalid and that the governor influenced IEBC officers to work in his favour.Kevogo added that the whole election was not conducted within the confines of the Constitution and electoral laws. However, the high court judge found no evidence on claims that the ODM governor was invalidly elected. “The evidence on record does not support the petitioner’s allegations that the third respondent (Dr Ottichilo) was not validly elected," Justice Sitati said as quoted by Nation. “Evidence on record shows Governor Ottichilo was validly elected. This petition is dismissed as incompetent. The petitioner’s case was vexatious and frivolous,” she added. Ottichilo defeated the former governor Moses Akaranga, who got 65,539 votes.
