The High Court on Friday upheld Lamu Governor Fahim Twaha's win in the August 8 general election.
In her ruling, Justice Dorah Chepkwony said the evidence provided by the former county boss Issa Timamy was not enough to nullify the outcome of the exercise. Timamy had moved to court citing massive illegalities and irregularities that saw his opponent from the Jubilee side bag the seat. He had asked the court to annul the election and call for a fresh one that would reflect on what he termed as the will of the residents of Lamu.The court ordered Timamy to pay Sh12 million to Twaha and the Independent Electoral and Boundaries Commission (IEBC) as the costs of the petition.Elsewhere, Likoni MP Mishi Mboko also survived a petition seeking to annul her win.In his ruling, Justice Erick Ogolla said the petitioner, Masoud Mwahima, failed to convince the court that the incumbent MP did not win the election in a free and fair manner.“The court finds that indeed there were some irregularities in the conduct of this election. However, they were so minor that they did not in any way offend the principle of free and fair elections,” said Justice Ogolla. He further asked Mwahima to pay Sh2.5 million to Mboko and the IEBC as the costs of the petition.
