A Mombasa High Court has dismissed a petition challenging the victory of Likoni Member of Parliament Mishi Mboko in the August 8 election.

In his ruling on Friday, Justice Erick Ogolla said the election was done in accordance with the law, adding that the results declared by the Independent Electoral and Boundaries Commission (IEBC) reflected the will of the people of Likoni.Justice Ogolla further said that the errors and malpractices highlighted by the petitioner were not sufficient to warrant a nullification.The judge, however, said the court did find some irregularities but they were minor and not sufficient to affect the outcome of the poll.The petition was filed by former Likoni MP Mwahima Masoud Mwalimu who moved to court to challenge the election of Mboko.During the case hearing, Mwahima had alleged that some of Mboko’s agents were involved in bribing voters to vote in her favour, claims that the ODM MP denied.Mwahima had further alleged that his agents were denied access to some polling stations and that form 35As were not signed by the presiding officers.Justice Ogola ordered the petitioner to pay costs amounting to Sh2.5 million.
