Former Nairobi governor Evans Kidero has moved to court to challenge governor Mike Sonko's victory in the August 8 elections.

Through an application filed by senior counsel Tom Ojienda at the High Court in Nairobi, Kidero is seeking to be enjoined as an interested party in a case filed by activist Japhet Moroko challenging Sonko's win.

According to the former governor, almost 800 forms out of 1300 form 37A's that were used to declare Sonko the winner had irregularities.

In his sworn affidavit, Kidero noted some forms lacked signatures from presiding officers and party agents, others were not stamped while some had varied dates despite being announced from the same polling station.

"Sixty two of the sampled forms 37A were not signed by party agents, with no reason for their absence indicated by the presiding officer. These represent 25,462 votes," noted the former ODM governor.

Kidero said the irregularities in the forms affected 308,918 votes which he notes are enough to affect the outcome of the election.

The Jubilee governor was declared the winner by the county returning officer, Eroo Melee with 869, 050 votes while Kidero garnered 695, 770 votes.

Kidero had earlier not expressed interest in challenging Sonko's win and had even conceded defeat.
