A Nakuru based businessman was on Wednesday arraigned before a Nakuru court accused of sexually assaulting a 24 year old man and infecting him with HIV and AIDS in the process.
Senior police officer Stephen Mathenge who was testifying before Senior Principal Magistrate Felix Kombo gave a shocking narration of how police intercepted the 35 year old man following allegations that he had molested the complainant.
Mathenge told the court that the victim had reported to Bondeni police station 5th March 2014 about the ordeal which had taken place the previous night at a rented house in Nakuru’s Pondamali estate, in the outskirts of Nakuru town.
According to a statement the complainant recorded in the police station, he claimed that he had been assaulted by a person who had offered him a place to sleep after he met him stranded in Nakuru town.
The victim further alleged that the owner of the house Jackson Muturi accorded him a warm welcome before turning against him at around midnight when he sodomised him and threatened to kill him if he raised an alarm.
Mathenge told the court that when police officers from Bondeni police station visiting the house in a bid to arrest the suspect, they found the place deserted as the accused had fled.
The accused was arrested on August 2 at Kagotho area in Nakuru County following a police hunt.
A medical report presented in court by Dr Thomas Matano from the RiftValley General Hospital where the victim was treated revealed that complainant had a anal injuries suspected to have been caused by penetration.
The report further indicated that the victim who tested HIV positive may have been drugged before the incident took place.
The accused has however distanced himself from the accusations and is out on a Sh200,000 bond as he fights the charges.
The court slated hearing of the case for November 25 when more witnesses will take to the stand to testify.
