In a detailed judgment by Nyamira High Judge James Makau, Mr Mouni deleted the name of one Irene Mayaka's name subsequently replacing it with his mother, Damaris Mouni.

"I hereby direct the the petitioner was illegally sneaked in without the knowledge of the party thus the first respondent was correctly nominated," read the ruling.

Judge Makau further said: "I hereby direct that the clerk of the aforesaid assembly to swear in the respondent as MCA."

And the ruling exposed dirty tricks within the IEBC which may land it in trouble with the ODM party.

According to Ms Mayaka, the petitioner had conspired with her son, then working as Chebukati's PA to remove her name from the ODM list.

"My name was submitted by the party as nominee for MCA on gender basis and I was shocked that she had replaced me without my knowledge.

"After follow up with the party, we found out that the criminal offense took place at the IEBC thus the ruling," she noted.

Although Mr. Mouni was allegedly dropped by Chebukati for leaking crucial information, other sources say that the chairman may have acted after learning about the Nyamira nomination incident.

His mother, who has since vowed to challenge the outcome, was however ordered to pay Sh500,000 to the respondent.
