In a Facebook post on Saturday, Kuria argued that the ruling might create a conducive environment for a coup attempt.

The vocal MP further advised Auditor General Edward Ouko not to interfere with the operations of the disciplined forces.

“Judiciary has ruled that Auditor General can audit confidential military and security matters. This is against traditions in all jurisdictions. Yet another invitation to interfere with our disciplined forces and create a conducive environment for a coup attempt. To my very good friend and professional colleague Edward Ouko, decline that invitation. You will thank me later,” read Kuria’s post.

In his ruling on Friday, Justice Chacha Mwita declared that sections of the Public Audit Act that barred the Auditor General from scrutinising military accounts were unconstitutional.

The judge argued that the Auditor General can use his constitutional mandate to audit the expenditure of public offices and run his office free from interference from the Executive.

Following the ruling, the Kenya Defence Forces, National Intelligence Service, and the Kenya Police Service will now have to account for the billions allocated to them in every financial year.
