A 51-year-old man was freed by a Thika Court on Friday from charges of assaulting his wife and causing her actual bodily injuries.
The accused, Joseph Mwangi, was charged that on August 20 this year at Kimorori village in Murang’a County, he stabbed his wife of 24 years, Susan Wangeci, after he caught her with another man in his house.
Appearing before Thika Chief Magistrate Stephen Mbungi, the accused accepted the charges and admitted that he engaged in a fight with his wife after he heard that his daughter had allegedly missed school admission due to lack of fees. He said he was not aware of the situation and on coming home, he caught his wife in their matrimonial bed with another man.
The accused who had no legal representative told the court that the relationship between him and his wife has been tensed since he caught her with another man in 2007. The incident caused a temporary separation but the two reunited later on to raise their daughter together.
On the material day, the accused narrated that he had come home at 1am and caught his wife with another man. He said that his wife rushed and held him so that the other man could escape and in a fit of anger, he stabbed her accidentally. He pleaded for leniency.
The magistrate ordered for the probation report which guided him on the verdict to make against the accused.
He was released under maximum supervision for two years.
