The son of former President Daniel Moi has said he is too poor to give his ex-wife Sh250,000 monthly maintenance fee, as ordered by the High Court.

Philip says the fee was awarded based on his family’s income, not his.

He says the monthly fee to Rosanna Pluda, his ex, should be reduced to Sh80,000.

“It was totally erroneous for the judge to award the respondent the maintenance against the Moi family (income), instead of Philip’s,” said Lawyer Tom Ojienda on behalf of the retired KDF major on Tuesday.

Philip says the 10-year payment period is untenable.

He says he is unable to pay debts and at the same time maintain Plunda’s monthly grant.

However, Pluda’s lawyer Judith Thongori, says High Court Judge Luka Kimaru was right to award her client the money.

She said her client has not worked since 2011, and needed the maintenance fee as Philip had neglected all his paternal duties.

Judge Kimaru awarded Plunda Sh90 million, saying it was due to “cruelty and perjury”. Of this, Sh30 million was for her personal upkeep.

The amount was to be paid within three months.

Philip Moi was also ordered to find his ex a house in Runda, Karen, Lavington or Kileleshwa, or pay Sh60 million more.
