Former Gem MP Jakoyo Midiwo has admitted that he lost the August general election. 

According to a local daily, Midiwo, the former immediate minority leader, said that Elisha Odhiambo was the winner of the poll, but the exercise was not credible. The politicians argued the voting process was marred by all sorts of irregularities and illegalities.

He was speaking at the Siaya High court on Wednesday during the cross-examination of case challenges the Odhiambo’s victory.

He claimed that there were illegalities committed in 98 polling stations but he could only identify 19 of them.  Midiwo, also Former Prime Minister Raila Amolo Odinga’s cousin said that the Gem returning officer Martin Omollo was in office illegally.

"The law requires that a returning officer be gazetted before assuming office. Martin Omollo followed the due process," said his lawyer, Willis Otieno said.

 The former lawmaker insisted that the returning officer Martin Omollo was supposed to act as an assistant administrative officer of Alego Usonga constituency office during the exercise. 

He further said that the RO is a close friend of Odhiambo, adding that the relationship is likely to have compromised the outcome of the exercise. He also claimed that he had raised concern but it was not addressed.
