A man on Tuesday accused his former employer of dismissing him without any formal communication.

Evans Mureithi told the Nakuru Industrial court that his past employer, JB Drilling Kenya, dismissed him verbally  without following due process as spelt out in the labour laws and that he was never issued with any notice impending termination of his employment.

“Termination of my employment was a surprise to me as it was not formally communicated to me but only done verbally. I was denied fair hearing before being laid off,” he told the court.

Mr Mureithi told Justice Stephen Radido that he was sacked on March 14, 2011 without fair hearing after working for the NGO for 11 years. At that time he was the finance officer.

The former employee testified that he only received Sh100,000 and a certificate of service from the NGO before he was shown the door.

But Tom Armstrong, a director of the accused organization, said all Mureithi’s terminal dues were paid before he was dismissed.

He said that at one time the NGO revised Mureithi’s salary downwards from Sh39,000 to Sh29,000 as a result of minimal funding from international donors.

Mureithi moved to court demanding compensation over wrongful dismissal, allowances and benefits he was entitled to before termination of his employment.

He sayd the “rude” dismissal he received from the institution adversely affected his chances of securing employment elsewhere, and subjected his familiy to untold suffering.
