The Independent Electoral and Boundaries Commission (IEBC) has moved to the Court of Appeal contesting a verdict by a Homa Bay court nullifying the election of Governor Cyprian Awiti.
This comes after former MP Oyugi Magwanga successfully petitioned against the victory of Awiti citing massive irregularities.
According to IEBC, the polls were conducted in a free and fair manner in all the polling stations across the county
The notice of appeal was drawn, filed and submitted at the Court of Appeal in Kisumu by a counsel from Orego & Odhiambo Advocates.
In the suite, the IEBC is the first appellant while the Returning Officer Michael Kosgei is the second appellant.Oyugi Magwanga and his running mate Joshua Orero are the first and second respondent respectively.
Meanwhile, Governor Awiti also moved to the Court of Appeal protesting a ruling that stripped him off his gubernatorial seat on February 20.
Awiti filed a notice of appeal at the Kisumu appellate court through his advocate Tom Ojienda, insisting that he won the seat through a fair and credible election.
