A petition by Bungoma resident Barasa Nyukuri giving the commissioners more headache...barasa claims IEBC staff were incompetent in conducting the 2013 elections and should not be allowed to conduct next year's polls. 

But IEBC Chairman Issack Hassan expressed dismay towards the petition saying it was filed in bad faith.

In a report to the Chepkonga led house committee, the commissioners challenged the petition saying it violated the constitution and further dismissed Nyakuri as a reliable petitioner arguing that he has no substantive expertise in electoral matters and only seeks fame through his allegations.

According to the auditor General 's report, the commission did not have a procurement plan for the 2013 elections and to which they failed to avail to the Chepkonga led committee on Monday.

Ouko earlier told a joint parliamentary committee that the country had lost Sh4.1 billion in the procurement of the 15,000 Biometric Voter Registrations which had malfunction problems on the election Day.

In addition, chairman Issack Hassan has raised concern saying they would be facing double jeopardy if they are subjected to face the parliamentary select committee even after honoring the summon by the justice and legal affairs committee.

The commissioners further said that if the Committee was to recommend disbandment, it would cause irreparable damage and would be prejudicial to public interest.
