Nyamira County Returning Officer David Towett has now called upon   the High court to uphold the win of Governor  John Nyagarama in an election petition launched by Walter Nyambati.

On Wedensday during a court session, Towett said there were no excess votes that were accumulated in order to announce Nyagarama as the winner.

During cross-examination by Nyagarama’s lawyer Nyagaka Nyachiro, Towett said that IEBC followed due process in declaring Nyagarama the winner.

 However Towett admitted that there were minor errors   committed during the transfer of data from forms 37A to 37B and 37C but insisted they would not affect the final outcome.

On bribery allegations by Nyagarama,  Towett said he was not aware of such claims adding that they could be fabrications by the petitioner.

The hearing is now set to continue on December 20 after the final recount of votes is over in 90 polling stations.
