Electoral body IEBC is facing yet another petition at the Supreme Court.
Thirdway Alliance leader Eukuru Aukot, who vied for president in the August 8 general election, has moved to the apex court to seek clarity on which candidates should participate in the fresh presidential election.
IEBC Chairman Wafula Chebukati has gazetted National Super Alliance (Nasa) presidential candidate Raila Odinga and Jubilee Party’s President Uhuru Kenyatta as the only candidates ahead of October 17 poll.
Dr Aukot wants to know whether other candidates should be barred, since the Supreme Court on September 1 said the presidential election will be “fresh”, and not a re-run.

“I believe that my political right and that of my constituents as enshrined in the Constitution are threatened, violated and infringed by the decision of IEBC and Chairman Wafula Chebukati to exclude me in the fresh election without lawful justification,” Dr Aukot says in his petition.
On Wednesday evening, in a letter to NASA and Jubilee, Chebukati made reference to the ruling made by former Chief Justice Willy Mutunga on Raila’s 2013 election petition, which said the fresh election will, in law, be confined to the petitioner and the president elect.
