Kiambu Town Member of Parliament Jude Njomo has filed a case seeking to compel IEBC to conduct the fresh presidential elections.
The ordered to conduct fresh polls was given by the Supreme Court.
According to Jomo, the withdrawal of NASA presidential candidate Raila Odinga is geared towards creating a political and constitutional crisis.
In his supporting affidavit, Njomo says that Raila’s withdrawal cannot lead to a cancellation of polls.
“The withdrawal of Raila is not binding as it was not done in accordance with the law,” argues the lawmaker.
He claims that it is in public interest that the orders sought be granted forthwith and hearing and determination of the petition be fast tracked as a matter of public interest.
Njomo says that the court has a sacred duty to ensure the fresh presidential election is held as ordered by the Supreme Court.
