A petitioner has moved to court seeking to compel the Independent Electoral and Boundaries Commission (IEBC) to make public a report on voter identification and transmission of presidential results ahead of the fresh polls.Appearing before Malindi Resident Judge Weldon Korir, Mr Gabriel Mwewe, a Malindi resident, argued that his decision to file the petition was advised by the Supreme Court’s ruling that declared the August 8 presidential election results null and void.In a sworn affidavit, the petitioner says that the nation will avoid any possible failures in future if the court rules in his favour. Mwewe listed President Uhuru Kenyatta, Deputy President William Ruto, NASA Presidential candidate Raila Odinga and his running mate Kalonzo Musyoka as interested parties in the case.He also argued that the nullification of the presidential election by the Supreme Court, led by Chief Justice David Maraga, is a clear indication that similar hiccups may be experienced in the October 17 repeat presidential elections, thus creating the need to put in place precautionary measures.“That is obvious from the Petition no 1 of 2017 at Supreme Court that the IEBC did not have a complementary mechanism which is the reason that the election was declared null and void,” states his petition in part.The case will be mentioned on September 19, 2017.
