[Photo|Capital FM]IEBC has found itself in another 'trouble', after former Kilome MP, Harun Mwau moved to court, to sue the electoral agency, for planning to hold a fresh presidential election on October 26, without nominations.Mwau, through lawyer Benjamin Musyoki, criticised IEBC chairman Wafula Chebukati, for publishing a gazette notice about the polls, saying it is against the law, Monday.He faulted IEBC, for adding other presidential candidates such as Ekuru Aukot to the ballot, saying the Supreme Court directed IEBC to hold fresh polls, meaning presidential candidates should be nominated as per the Elections Act."It is clear that IEBC and Mr Chebukati are seeking to waive provisions of the Constitution and the law, which they have no power to do so. If the fresh presidential elections are allowed to proceed just as the sued parties intend, the Supreme Court, like night follows the day, will invalidate the same," said Mwau through his lawyer, in his suit papers, seen by Daily Nation. He now wants the High Court to determine if fresh elections can be held without nominations, among other issues.IEBC vowed to continue with the election, with President Uhuru Kenyatta's Jubilee Party, saying elections would go on, as planned.
