The Independent Electoral and Boundaries Commission (IEBC) lost its bid to prevent Cord and the Jubilee party from being enjoined in a case where it is accused of irregularly awarding tender.
A South African firm, Paal Media wants a Sh2.5 billion tender issued to a Dubai-based firm, Al Ghurair by the IEBC, revoked.
The matter is currently before the Public Procurement Administrative Review Board.
During Thursday's hearing, the Board's chairman Paul Gicheru ruled that both Cord and Jubilee had the right to participate in the case.
Through Senior Council James Orengo, Cord filed an application to be enjoined in the case, while Jubilee was represented by lawyer Hillary Sigei.
The parties argued they were persons of interest in the case, for it involves their political parties.
IEBC through lawyer David Lebullelah had contested the request, arguing that they had no business engaging in a tender row between a procuring entity and its bidders.
