It was a bumpy start for the much-anticipated meeting between the joint select committee and the IEBC commissioners.
Even before the committee began its proceedings, IEBC chairman, Issack Hassan raised preliminary objections as to whether the committee was well within its mandate to decide whether or not to send the commissioners home.
Hassan argued that the committee was violating article 251 of the constitution by doing so.
This prompted the chairs to prematurely adjourn the session for close to three hours to allow the committee members deliberate on the issues raised.
But co-chairs, Senator James Orengo and Kiraitu Murungi ruled out the objection saying the committee was well within its jurisdiction to inquire into any matter according to provisions of the constitution.
The commissioners, however, opted not to respond to allegations against the commissioners and neither would they recommend legal mechanisms for their vacation as is provided in the mandate of the commission.
Issack said the commission will provide memorandum on individual commissioners implicated in any malpractice.
The electoral body boss said the said commissioners will answer to allegations to the committee individually in the next 24 hours.
Nevertheless, the electoral body said they have a strategic plan set out to ensure the 2017 elections would be credible and fair. They reiterated that they learnt a lot from the 2013 elections.
The committee members are expected to go through the submissions presented by the commissioners before the sitting with the electoral body resumes on Tuesday morning.
