An IEBC presiding officer was released on a Sh1 million cash bail or Sh2 million bond or similar surety for committing an electoral offence.
Mark Otieno, North Ugenya PO, is accused of failing to seal ballot boxes and transporting the unsealed boxes to the constituency tallying centre on August 9.
He denied the charges when he appeared in court on Friday.
Siaya principal magistrate Selesa Okore said the case will be mentioned on August 25 and heard on August 30.
Three other presiding officers were arrested at Siaya Institute of Technology for abandoning ballot papers at the tallying centre on Friday night.
The boxes belonged to Nyamila, Liganwa and Kochieng Primary School polling stations.
"The POs were so drunk and had not yet surrendered the results to us. We only found the ballot boxes abandoned in the compound," said Alego/Usonga returning officer Maurice Simiyu.
