The High Court in Kiambu on Thursday nullified the election of Ms Wanjiku Kibe as Gatundu North Member of Parliament.

Justice Joel Ngugi in his ruling said that the August 8, 2017 election was not free and fair.

The petition was filed by former Gatundu North MP Clement Waibara who moved to court to challenge Ms Kibe’s election saying the process was marred by massive irregularities.

Judge Ngugi ruled that the Independent Electoral and Boundaries Commission (IEBC) did not conform to the law in conducting the election citing failure by the commission to enter correct results of forms 35B.

The judge however absolved Ms Kibe of any wrongdoing saying that she never participated in propagating the irregularities.

Judge Ngugi ordered IEBC to pay Ms Kibe Sh3 million as legal fee while the petitioner, Mr Waibara, will be paid Sh1.5 million.

Mr Waibara, in his petition said the elections were not free and fair as required by the constitution arguing that there was no proper collation, tallying and tabulation of the results.

A returning officer had testified before the court that fake ballot papers were recovered in a thicket and in dustbins by the police on August 20 and they bore official IEBC stamps.

The court also heard that out of the 29 polling stations that were scrutinized, at least 12 had their copies of Form 35 As missing inside the ballot box.
