The Independent Electoral and Boundaries Commission (IEBC) said the election would proceed as planned even if NASA presidential candidate Raila Odinga withdrew from the race.Tht IEBC told The Star the Opposition leader's withdrawal had already been overtaken by time as he was to do it within three days of being gazetted.IEBC banks on a legal position where according to Regulation 52(1) of the Election (General) Regulations , where Raila would have to formally inform the IEBC that he had withdrawn from the race, within three days after nominations.The fresh election ordered did not trigger a nomination process and the IEBC declared President Uhuru Kenyatta and Raila the only two candidates through a gazette notice.This means Raila would have withdrawn from the race three days after the gazettement.
