[Photo: The Star]The Independent Electoral and Boundaries Commission (IEBC) has said that the fears of a crisis as a result of Nasa presidential candidate Raila Odinga's withdrawal from October 26 poll, were solved when the High Court allowed the inclusion of other candidates in the repeat poll.Arguing on Monday before the High Court judge, Justice Chacha Mwita, IEBC said seven other candidates will participate in the repeat election despite Raila's withdrawal, reports the Star.The electoral agency said this during the hearing of a suit filed by Pokot South MP David Pkosing, which seeks to force Raila to participate in the repeat presidential election slated for October 26.Pkosing argued that Raila must comply with the Supreme Court decision that ordered a fresh presidential election.Through lawyer Kibe Mungai, the MP said Raila’s threats to boycott the election if certain conditions are not met is unlawful."The threats by NASA that fresh presidential election will not be held as scheduled may actually materialise in a significant number of constituencies and counties, thereby putting Kenya’s constitutional order into jeopardy," Mungai said as quoted by the Star.Raila, however, declined to defend himself in the suit where he had last week been ordered to file replies to the suit by Monday. The court was forced to hear the case without his participation and a ruling is expected on October 24.Raila has withdrawn from the repeat poll and declared that there will be no election on October 26 as scheduled by the IEBC.Attorney General Githu Muigai said it was Raila’s right to pull out of the race but noted that he has no right to obstruct voters from electing their preferred candidates.
