Lawyer Moseti Moseti says IEBC should be stopped from conducting an election on grounds that it has yet again failed to honour the Supreme Court order.
On Monday, IEBC set October 17th as the date for presidential elections adding that ballot papers will only reflect the names of President Uhuru Kenyatta and Raila Odinga.
And in his weekly column on Nyamira Facebook page, Moseti says all candidates who were on ballot paper and any other interested party should be included.
“The court was very clear just like the constitution. A fresh election allows any interested party to take part in those elections.
“This is not a rerun and I am shocked IEBC can make such grave mistake even barely a week after they were dealt a blow. They should go back to the drawing board and deal with the issue,” he says.
Neither Jubilee nor opposition NASA has come out to discuss the date that has been fixed by Chairman Wafula Chebukati.
Should the process go on, any interested citizen according to Moseti can sue the commission of a certificate of urgent.
