The Inspector General of Police Joseph Boinnet and his Deputy, Joel Kitili risk being jailed over court contempt.

This follows an application by former police officer Henry Nyakoe Obuba who asked the court to hold the two in contempt for disobeying an earlier ruling by the Employment and Labour Relations court.

On May 13, Justice Byram Ongaya had granted the request by the former policeman and directed the IG’s office to re-hire and pay him an accumulated salary of Sh10 million, something which has not been done to date.

Mr Ongaya had sued the IG for unlawfully firing him in 2007.

However, Boinnet, through his lawyer Francis Makori, wants the court to dismiss the application on grounds that his clients had not disobeyed the court order but had accepted to obey the orders to pay Nyakoe Sh3 million.

It is not clear whether the defendants will also agree to honour the orders directing them to pay the accumulated monthly salaries for the period Ongaya was out of service.

If Obuba wins the case, Boinnet could be sent to jail, becoming the first sitting IG to go behind bars.
