Two key witnesses in Jama's case on Tuesday failed to appear before the Garissa court.

The absence of the witnesses dealt the case a blow and so the case had to be delayed further.

Jama is accused of allegedly failing to comply with the procurement procedures that was reported in a contract that the county had awarded the Kenya Red Cross' E-plus to avail emergency and ambulance services.

The court heard that Abbas Gulet, the Red cross Secretary General and his general manager Susan Ng’ong’a were out of the country on official duties.

Principal Counsel Bonny Okemwa delivered to the court that the duo, who were to lay the grounds for the case, had gone for an overseas mission in Sweden.

Jama was charged together with Sahal Abdi, Jawahir Keynan, Mohamed Hassan Mohamed, Rahma Dekhow and Muhamed Sofia.

However, the defence lawyers Amunga Cohen and Paul Nyaga rejected the application by the prosecution side for adjournment of the case, saying it would widely infringe on the rights of the accused persons.

The defence argued that the prosecution side had initially submitted to the court that it was ready to push on with the hearing of the case.

Chief magistrate Margaret Wachira in turn ruled in favour of the prosecution, stating this was the first time it had sought a postponement.
