The Ombudsman has written to the Director of Public Prosecution Keriako Tobiko calling for the investigation and prosecution of State and public officers breaching electoral laws.
In a letter dated July 14 and copied to the Independent Electoral and Boundaries Commission (IEBC) and Auditor General Edward Ouko, acting ombudsman Regina Mwatha said her office had noted acts where State officers have been engaging in campaigns as elected leaders particularly governors broke electoral regulations by advertising their achievements in the media.“Our attention has been drawn to complaints from the public and reports in the media to the effect that some appointive State officers and public officers are participating in public activities, as well as the use of public resources in political activities in contravention of the law,” the Ombudsman said.Those the Ombudsman wants investigated include Governors Peter Munya (Meru), Hassan Joho (Mombasa), Paul Chepkwony (Kericho), Simon Kachapin (West Pokot) and Julius Malombe (Kitui).Munya, Joho, Chepkwony and Kachapin are accused of placing adverts in the press highlighting their achievements contrary to 14(2) of the Elections Offences Act while Malombe is claimed to have changed the number plate of a county government vehicle and used it during campaigns contrary to section 15 (1)(d) of the elections law.Others include secretary for delivery and head of presidential delivery Andrew Wakahiu who is accused of running adverts in the media with Jubilee achievements and Kenya Revenue Authority director general John Njiraini who has actively been engaging in campaigning for Jubilee.Namangofulo secondary school principal in Bungoma is also accused of releasing his school bus to be used in Jubilee campaigns in the county.Also in the list of those facing investigation are Trans Nzoia County Commissioner Ann Gakuria, Energy PS Joseph Njoroge, Leather Development Council Board Chairman Titus Ibui and Interior PS Karanja Kibicho. The officers are said to have engaged in active campaigns in favour of Jubilee on different days.
