The High Court has ruled in favour of Mombasa Governor Hassan Joho after it allowed him to keep his firearms.
In his ruling on Friday, Justice George Odunga quashed a decision by Interior Cabinet Secretary Joseph Nkaissery directing chief licencing officer Samuel Kimaru to revoke Joho’s firearms certificates.
The Judge termed the move as unlawful saying it was done in an unprocedural manner, adding that there was no evidence to justify Joho was unfit to manage his guns.
Justice Odunga further prohibited the CS from harassing the governor or any his employees.
“This court hereby restrains the respondent from harassing and arresting the governor on basis of the instructions of the chief licencing officer. The Constitution is the supreme law that binds state organs and officials. However, those privileged to have licences for firearms must exercise caution as a firearm is not a symbol of power by those in authority,” he said, as quoted by the Standard.
Joho, who has been a licenced holder since June 18, 2008 filed the case in March after he was ordered to submit his guns to Mombasa police over alleged involvement in violence during the Malindi by-elections.
