The High Court has summoned the Inspector General of police Joseph Boinnet and the DCI Director Ndegwa Muhoro over the alleged missing of the late Ibrahim Akasha’s sons.
Akasha family’s lawyer Cliff Ombeta had sought orders from the court, saying the whereabouts of Baktash Akasha, Ibrahim Akasha, Gulam Hussein and Vijaygiri Anandgiri remains unknown since their arrest in his presence on Saturday.
The lawyer further claims that phones belonging to the four remain switched off, with the family members failing to trace them at any police station within Mombasa County.
The lawyer has now taken the case to the High Court and lady justice Njoki Mwangi has consequently restrained the police from moving the four out of Mombasa.
The men are wanted by the US government on allegations of drug trafficking.
“We have these officers whom I saw personally and I have mentioned their names, they need to be summoned they need to be able to tell this court where these people went, they need to come and explain,” said Ombeta.
“These concerns expressed by the defense, regarding the whereabouts of the suspects, this court can therefore not issue any orders at this point, the subject are not without a remedy though, and they can approach the high court and appropriate orders they wish to seek from the high court,” added Mwangi.
The High Court had last week stopped the extradition proceeding temporarily for parties to argue an application by the Director of Public Prosecutions.
