Their was joy and dance outside the Kisii High Court as Justice Winfridah Okwany dismissed an election petition challenging Alphathe win of Bomachoge Chache's MP Alpha Miruka.

Supporters and Mr Miruka could not hide their joy as they celebrated the win of a case that at some point looked tough for them. 

Mr Miruka speaking after the ruling said that he was pleased with the ruling as he asked his opponents to work with him for the benefit of the people. 

"I am happy and I now extend an olove branch to my opponents to join hands with me and we work together for the next five years," he said. 

Mr Miruka said that the constituency had lagged behind in terms of development and their was need of all that competed against him sharing ideas to help the locals.

In her ruling on Monday morning Justice Miruka, ordered the petitioner Mr Jeremiah matoke who contested on an ODM ticket to pay a fine of Sh 5 million as costs. 

Justice Okwany threw the petition out for lack of enough evidence.

In his petition Mr Matoke had argued that the election was not carried in a free and fair manner. 

He also argued that 37 polling stations had more votes than the nunber of registered voters.

"I there note  that the MP  was elected  according to the constitution election act,"said the judge.
