Bobasi MP Innocent Obiri was on Sunday locked up in Kisii Central Police, a day after spending another cold night at Central Police in Nairobi.
The first term PDP legislator is being accused of incitement and causing disturbance and will be arraigned in Ogembo and Kisii High Courts on Monday.
He is alleged of assaulting workers in a quarry at his constituency where he claims that the mining activities was putting buildings in danger.
"He will be charged with offences of assault, causing bodily harm and malicious damage of property," said Kisii Police Commander Abdi Hassan.
Nyamira Senator Okong'o Mogeni is leading a troop of lawyers in the MPs defense and on Sunday accused the police of 'infringing' the MP's rights.
"They have locked him and denied us access to him. We want him out on bond as we pursue the matter in another level," he said.
Early this year, the PDP MP was quoted supporting DP William Ruto's 2022 bid in a rally that was attended by Interior Cabinet Secretary Fred Matiang'i.
