President Uhuru Kenyatta's Jubilee party has asked the Director of Public Prosecution Keriako Tobiko to prosecute NASA co-principal Musalia Mudavadi and Siaya Senator James Orengo for allegedly accessing IEBC's servers illegally.Through a letter written by Jubilee's secretary general Raphael Tuju on Friday, Jubilee wants Tobiko to investigate how Orengo and Mudavadi accessed IEBC server logs without permission.Tuju cited an August 10, 2017 letter written to IEBC chairman Wafula Chebukati by the two NASA leaders telling him they had secretly obtained information on the actual presidential results from the commission's servers using “confidential sources.""The two informed Chebukati that they had surreptitiously obtained information of the actual presidential election results contained in the IEBC servers," read part of Tuju's letter.
The ruling party has insisted the revelations made by NASA are a breach of both the Elections Act and the IEBC Act.“We request your good office to expeditiously direct comprehensive investigations and prosecution if your investigations uncover sufficient evidence, pursuant to the provisions of the IEBC Act, Election Offences Act, and Communications Act, Penal Code and any other law against Hon. Mudavadi and Senior Counsel James Orengo and any other person who has anauthorised access to the IEBC servers,” added the letter.Tuju has further written to Chebukati seeking to have the ANC leader and the NASA lawyer prosecuted for making public, the information they had accessed illegally. Jubilee's later came just hours after the opposition team had written go the DPP seeking him to prosecute IEBC officials who bungled the August 8 polls.
