On Thursday, Judge Luka Kimaru declared Miguna's deportation 'illegal, invalid and unconstitutional' and demanded surrender of his confiscated passport within seven days.

And Meru senator Mithika Linturi along with Buuri MP Rindikiri Murethania warned that violation of court orders could set 'bad precedence' in future.

"The state should have taken him to court to challenge nationality. They failed to do that and it is fair to return his passport," Linturi said.

On his part, Murethania said: "Let us stop harassing people however much we defer politically. The state should also learn to obey court orders. We are not a banana republic."

Inspector General Joseph Boinet and DCI George Kinoti are set to appear in court and were charged with contempt over Miguna Miguna's debacles.

The government has since moved to court to appeal against the invalidation of Miguna Miguna's deportation.
